Amusement Permits
In accordance with the Betting, Gaming, Lotteries and Amusement (Northern Ireland) Order 1985, the Council may grant an amusement permit for certain premises.
These include:
premises used for the provision of gaming machines with a maximum all cash prize of £25.00 as defined by Article 108 (1) (ca) of the above Order. The fee for such premises is £250.00
or
premises used for the provision of gaming machines with a maximum all cash prize of £8.00 as defined by Article 108 (1) (c) of the above Order. The fee for such premises is £32.00
The council may impose conditions regarding:
- number of gaming machines,
- requiring the premises to be illuminated as specified by the Council,
- notices and information to be displayed,
- restrictions applicable where £8.00 and £25.00 jackpot machines are operated on the one premises and admission to the premises is not restricted to persons aged 18 years or over,
- advertising and window displays permitted.
- closing time of premises wishing to operate beyond 10.30pm
A fire certificate must be in force for the premises before the Council may grant an amusement permit.

Entertainment Licensing
The Local Government (Miscellaneous Provisions) (NI) Order 1985 requires that any premises providing entertainment of the kind listed below must have an Entertainment Licence. Such premises may include pubs, clubs, hotels, theatres, concert halls, dance halls, community halls, church halls etc.
a. A theatrical performance
b. Dancing, singing or music or any other entertainment of a like kind
c. A circus
d. Any entertainment, which consists of, or includes, any public contest, match, exhibition or display of e.g. boxing, wrestling, snooker, darts etc.
e. Outdoor public musical entertainment, which is held wholly or mainly in the open air, and at a place on private land.
There are a number of exemptions to the above list, of which the main one, is music or singing in the course of a religious meeting or service.
Premises licensed by the Council for the provision of Entertainment will have terms and conditions attached to the licence to control the activity and ensure the safety of persons taking part in and attending such events. The following may be specifically addressed on the licence.
1. Regulating the conduct, days and hours of use and general arrangement of the place;
2. Securing adequate fire precautions;
3. Securing the provision of facilities for the disabled;
4. Securing the provision of adequate sanitary appliances and things used in connection with such appliances;
5. Preventing persons in the neighbourhood being unreasonably disturbed by noise;
6. Securing that there is in force a policy of insurance insuring the holder of the licence in respect of any liability which may be incurred by him in respect of the death of, or bodily injury to, any person while on or about the premises.
Licences may be annual or occasional. An annual Entertainment Licence will remain in force for up to one year but an Occasional Entertainment Licence may be granted for a maximum of fourteen unspecified days in a year.
Licence applications must be made in writing on the approved form accompanied by the required fee and necessary documentation, details of which are given in the explanatory note on the application form.
Entertainment Licence fees are determined by the Department of the Environment Local Government Policy Division and are applicable across Northern Ireland. The fees structure applicable to the grant, renewal or variation of all Entertainment Licences effective from 1 September 2009 is shown in the table below.

Petroleum Licensing
The Environmental Health section provides a Petroleum Licensing function in accordance with the Petroleum Consolidation Act (Northern Ireland) 1929.
Premises where petroleum is stored and dispensed by mechanical means whether on resale premises (ie Petrol stations) or on private sites (ie for company vehicles) require to be licensed by the Council.
Petroleum licences are valid for a period of one year and require to be renewed annually. Premises are subject to inspection by the Council to ensure compliance with the terms and conditions of the licence.
Petroleum Licence fees are set by central government and are as follows:

Street Trading
The Street Trading Act (Northern Ireland) 2001 enables District Councils to regulate Street Trading by preventing undue nuisance, interference or inconvenience to people and traffic.
The Act requires Castlereagh Borough Council to designate specific areas, streets or part thereof in the borough as being suitable for street trading [not including Mobile or Temporary Street Trading applications]. This is designed to be an open system, which gives everyone an opportunity to comment on the proposal to permit street trading in a particular area.
Street trading is selling any article or thing, or supplying a service in a street (also includes offering or exposing for sale) and anyone carrying on any of these activities on or near a street can only do so with a valid Street Trading Licence.
The Council can now enforce this legislation by means of Fixed Penalty, Prosecution and/or Seizure of goods and stall.
Types of street trading are;
1. Stationary where the trading is carried out at a fixed location at regular times and days e.g. Hot Food Van.
2. Mobile trading occurs when the trader calls to an area and sells to customers for a short time and then moves on to the next area e.g. Ice Cream Van.
Temporary licences may be issued for special events.

The portion of the fee to cover the administrative cost of an application, which is subsequently refused, is £48.00. This is non-refundable.
